Offences Under the Act

The Private Security Industry Act 2001 created various offences relating to SIA licensing and our Approved Contractor Scheme.

Offence Penalties
Engaging in licensable conduct without a licence [Section 3(1)]

Contravening licence conditions [Section 9(4)]

Obstructing SIA officials or those with delegated authority [Section 19(5)]

False statements to the SIA [Section 22(1)]
Upon summary conviction, a maximum penalty of six months imprisonment and/or a fine of:

- in England & Wales, an unlimited amount;
- in Scotland, up to £10,000;
- in Northern Ireland, up to £5,000.
Employing unlicensed persons in licensable conduct [Section 5(1)]

Using unlicensed vehicle immobilisers [Section 6(1)]
Upon summary conviction, a maximum penalty of six months imprisonment and/or a fine of:

- in England & Wales, an unlimited amount;
- in Scotland, up to £10,000;
- in Northern Ireland, up to £5,000.

Upon conviction on indictment, a maximum of five years imprisonment and/or an unlimited fine.
Falsely claiming approved contractor status [Section 16(2)]

Providing private security services when not approved to do so [Section 17(2) & Section 17(3)]*
Upon summary conviction, a maximum penalty of six months imprisonment and/or a fine of:

- in England & Wales, an unlimited amount;
- in Scotland, up to £10,000;
- in Northern Ireland, up to £5,000.

Upon conviction on indictment, an unlimited fine.

Where an offence is committed by a body corporate and is committed with the consent or connivance of, or attributable to any neglect on the part of a director, manager, secretary or other similar officer of the body corporate, then that person is guilty of the offence and can be punished accordingly.

*An offence under section 17 of the Act can only be committed if it is made compulsory for private security companies to be approved under our Approved Contractor Scheme. The Act does allow for this, but there are no plans for that part of the Act to be brought into effect.

This is a simplification of the provision for offences and criminal penalties within the Private Security Industry Act 2001 (as amended).
